Canadian citizen with disability held in hospital against family wishes to transfer her to another hospital in Romania
Hi there, we are in Canada the family of a 42 old woman with down's syndrome who was taken off the layover plain from Toronto to Romania, in Munich and taken forcefully against to the Freizing hospital. She is currently with her mother at the hospital, scared and terrified, has panic attacks and traumatized. Doctors are not providing the family with expected stay and are told that she has pneumonia and is held in ICU tied to a bed. Family requested her transfer with a car that has been arranged for her to Romania to be taken to the hospital there where language is not a barrier. Family requested she be given medication and oxygen during her trip and at the very least released from the ICU where is constantly sedated and medicated with brute force. Family does not trust the medical treatment offered and is willing to sign a liability waver to take responsibility for her health. Hospital refuses to cooperate. please help, we are also in contact with canadian consulate in Germany.

This sounds very stressful; I am sorry that this is happening. Please note; these answers are provisional, as we do not know the exact situation and cannot give legal advice.
In general patients have certain rights in Germany. They or their guardian can decide what type of treatment they agree to. So one option would be to go to a lawyer in Germany, this of course would cost something.
It’s great that you are in contact with the consulate. Where they able to help?

Thank you so much. So far the hospital has not gone against our wishes with the treatment so we are monitoring but i will contact the organization above and we do have a list of lawyers provided by the consulate.
