Clarification Regarding my child Residence determining location and Child’s Best Interest
I firmly believe that:
- German protection and separation laws have been misused to portray me as a threat without any factual or legal basis.
- My former two lawyers failed to represent my case truthfully and neglected to present crucial evidence that could have disproven the allegations.
- My apartment was robbed, and the wife confiscated confidential documents including my passport, visa ,surrogacy contract paper and my daughter’s birth certificate. Despite repeated requests, no police report has been released to me.
- I have been subjected to continuous legal harassment through multiple false and malicious cases, and no authority has undertaken a fair review or verified the facts.
- During child visitation proceedings, my wife repeated the same false allegations, yet no cross-questioning or fact verification was carried out by the Family Court.
- Collectively, these actions reflect systemic bias, procedural lapses, and administrative negligence, resulting in serious violation of both my parental rights

- Conduct an internal administrative review of the Family Court’s handling of my case.
- Confirm whether any protection order was ever legally justified or validly issued against me.
- Provide immediate assistance in obtaining my pending police report and ensuring the return of all confiscated documents.
- Guarantee that custody and visitation matters are reviewed on the basis of verified evidence and fairness, not on unsubstantiated allegations.
- Initiate an independent inquiry into the misuse of protection and separation laws in my case, particularly their exploitation against an immigrant parent.
- Allow me full access to relevant court and police records and the opportunity to present my side of the case completely and transparently.
- I am a skilled professional from India who came to Germany only for temporary work experience, not for permanent settlement. My purpose was professional development and cross-border exposure, not immigration or long-term residence.
- My permanent home, family, and social ties remain in India, where my parents, relatives, and extended family live. India provides my daughter with a safe and stable environment, strong cultural roots, and the care of her grandparents and extended family.
- Given these facts, I sincerely believe that the best interests of my daughter — both emotionally and developmentally — lie in being raised in her home country, surrounded by family, language, and culture. I want my minor 4 yr child back to my country
