I want to bring my wife to Germany but how?

Last week my wife came to Germany as she has french 10 years document as Afghan like me and we got married here at home.I have Aufenthalsgestattung i cant travel but have my own job and private apartment. Now we are married without any single paper but photos and i want my wife to live here with me after registration of marriage in Standesamt and she doesn’t lose her French documents. My question is should she do Asyl here or do something else because Aslenderbehorde said i have to apply from German Embassy in France but i do not have Aufetahlstitle. Any best way if you could recommend?

Thanks

Dear Sohail, thank you for sharing the situation.

First of all and above everything else, I do not recommend your wife to apply for asylum in Germany. She has a legal long-term and secured residence permit in France and applying asylum in an other Schengen country, will definitely lead to a Dublin process which might endanger her status.

you can try to register your marriage in Standesamt, but have in mind that based on your situation, both of you need to provide some legal documents (ex. birth certificate, passport, Certificate of No Impediment to Marriage from your country of origin,...)

and last but not  least, with your Aufenthalsgestattung, you have no right for family reunification. But since you work and afford your life, there might be an option for you to change your residence type (Zweckswechsel) and withdraw your asylum application (in case you are ensured that it's a better option for you).

considering all these, my recommendation will be getting legal advise from a lawyer or a consultation center for migrants and refugees, before taking any further action.

If you tell me where are you living, I can find some links for you.

wish you a good day
