Opportunity card to work permit

Hello all,

I did my Master's in Marketing and then switched to looking for a job. In the end, I found a job as a Sales Advisor at Uniqlo. When I wanted to change my visa to a work permit, Immigration didn't allow it, saying that this job is not a skilled, qualified position. However, I told them that I would get promoted every three months and that I have a good future with this company. The officer told me that I should get promoted and then apply again, but for now, they would change my visa to an Opportunity Card. He also mentioned that if I got promoted or found a better position, I would need to work for two weeks to see if I liked the job and if the company liked me.

Now I have been promoted and transferred to a better position in the same company, and I have started working 40 hours. I have also applied for a work permit.

My question is: until I receive a reply, am I allowed to work full time? Because I have just changed my contract and moved to a better position, which is only for 40 hours.

May I ask, if you already received a residence permit for the Opportunity Card? And after you receive the new position, you started a full time job immediately?

I received my residence permit (Opportunity Card), but it will expire soon. Last month, I started a new full-time (40h) role at my company and have already applied for a work permit. I am still waiting for the decision. In the meantime, can I continue working 40h, or do I need to go back to 20h?

Hello @Dhoni ,
as I understand, your current residence permit is Opportunity Card. With this permit, you are only allowed to have a secondary employment in part-time (up to 20 hours/week). Your new position must meet the requirements for a residence permit for skilled workers so that the immigration office can change your residence status from an opportunity card to another residence permit.

To do this, the immigration office must first check whether the new position meets the requirements. Until you have permission from the immigration office, you are not allowed to work full-time. Only a trial period of full-time work in a qualified position is possible with this residence permit for two weeks.
If you still work full-time, you would be working without the required work permit. This could have legal consequences for both you as an employee and your employer.
