Submitted naturalization application a year ago

Hi! Just wanted to get an idea if my situation is normal or not. A year ago, I submitted an application for citizenship. The whole procedure was online. I heard from LEA in December. Pretty standard: they asked for my recent payslips, proof that I paid rent and also asked me to sign, scan and send them Erklärung zur freiheitlichen demokratischen Grundordnung through online form. I did it all without delay. Still, to this day, I didn't hear back. The people around me who had submitted their applications after me, already got invitation for naturalization. I have asked for clarification or feedback on my case through online form several times - but didn't hear back. I think my case is pretty simple and there should be no problems with the documents, so this delay really bothers me. I am seriously considering Untätigkeitsklage. My question is, is this application processing time normal, or is it a sign that something is wrong, and I should be worried? How advisable is the Untätigkeitsklage? If anyone has experience or thoughts, it would be appreciated! Oh, and I live in Berlin.

Unfortunately, what you’re experiencing in Berlin is not unusual. Processing times for citizenship applications are often very long, and the procedures, especially in Berlin, tend to be inconsistent among different applicants. While it’s frustrating, this kind of inconsistency does not necessarily mean something is wrong with your application.

The Untätigkeitsklage (action for failure to act) is a legal right available to you if the authority hasn’t made a decision within a reasonable time (typically after three months) unless they can justify the delay. 

However, while it is a legitimate option, we can’t offer strategic advice on whether you should file it. That decision depends on your individual priorities, the risks you’re willing to take, and the specific details of your case.

What is generally advisable is to contact the authority again,and inform them that the delay is unusually long and that you are considering taking legal action if no response is given soon. After that, it may be helpful to consult a lawyer who specializes in administrative or immigration law. They can assess your specific situation and explain the pros, cons, and chances of success with an Untätigkeitsklage, as well as whether alternative steps may be more effective.
