Hallo, guten Abend, bitte. Ich habe viele Fragen zu meinem Asylantrag hier in Deutschland 🇩🇪. Ich lebe jetzt seit über sechs Jahren in Deutschland. Und unser Asylantrag wurde abgelehnt. Ich habe hier zwei Mädchen zur Welt gebracht. Mein Anwalt hat meinem Mann gesagt, er solle schnell mit der Ausbildung beginnen, und mein Mann hat die dreijährige Ausbildung begonnen, aber leider konnte er sie nicht beenden, aber er konnte ein Jahr machen. Und was mich betrifft, ich habe jetzt meinen Deutschkurs gemacht und bin jetzt mit meinen B2-Prüfungen fertig. Meine Frage ist jetzt, dass ich meinen Reisepass gemacht habe und so große Angst habe, ihn ihnen zu geben. Ich würde die Ausbildung gerne fortsetzen, aber ich habe Angst, weil ich seit über einem Jahr meinen Ausweis nicht bei mir habe. Er ist bei der Ausländerbehörde und mein Mann hat auch keinen eigenen dabei. Er hat vorher gearbeitet, aber sie haben ihn wegen seines Ausweises gestoppt.

Bitte, was müssen wir tun? Ich brauche einen Rat.

From your message we understood that you currently have a tolerated stay ("Duldung"). There are ways to switch from a tolerated stay to a residence permit. It is difficult to fulfill the requirements and it takes a long time. There might be a possibilty to gain a residence title by doing an apprenticdeship. You might also be able to apply for a residence permit through your children. About giving your Passport to the Authorities: Asylum seekers have obligations to cooperate ("Mitwirkungspflicht"). One of these is the obligation to obtain a passport. This means that asylum seekers must provide their passport to the immigration authorities or prove that they are unable to obtain one. If they don't do this, they may fall into what is known as "Duldung light". This is a status with severe restrictions, such as a ban on employment (https://life-initiative.org/hgt-duldung-fur-menschen-mit-ungeklarter-identitat-12-2024-en/). If you currently have a tolerated stay ("Duldung") under §60b, your situation will not change as long long as you do not present your passport to the authorities. However, submitting the passport may increase the risk of deportation. Therefore, we strongly recommend that you seek legal advice from your lawyer or contact a counseling center.
