The Answer from BAMF

Hello! I hope this message finds you well

I have received my answers from BAMF three months ago which was the national ban on deportation for one year and I sent my request for an ID Card to Ausländerbehörde but after waiting for Such long period of time today I went there and asked them about, but they said to me as long as you don't receive the letter from BAMF which says that your application has been closed as you have accepted our decision which is sent minimum after two weeks of the BAMF answer.

So now what should I do what is the best way and solution?

Hello @Zabihullah , I would suggest that you bring you decision from BAMF with you when you go to your appointment the immigration office. It is always a good idea to make a copy of such important documents. Have you already shown the letter from BAMF to one of the workers at the immigration office? I have also found a migration counseling center in your area. You can call or send them an e-mail them and make an appointment, they can also guide you further. You can find the contact information here: https://www.caritas.de/adressen/caritasverband-fuer-das-dekanat-mersebu… It is also good to know that once you have officially applied for the ID it can sometimes take a while until you receive it. In the meantime you should then receive a so called “Fiktionsbescheinigung” make sure to check if it states that you can also work. Thank you but I have been twice to Ausländerbehörde and both the time I have shown the papers which I have received from BAMF and the only thing thave said to me is to wait by the way thanks for help

@Zabihullah I am sorry to hear that the Ausländerbehörde is so unhelpful it must be very frustrating. 3 Months is a long time. I will contact the counselling center close to you and see if they can further help you to sort out this issue with the immigration office. . Usually after you have filled out the application for a residence permit or "Antrag auf Erteilung einer Aufenhaltserlaubnis" they should give you a so called temporary paper or "Fiktionsbescheinigung" until you receive your ID. . It is also good to know, that in case you have appealed against the decision from BAMF, you will continue to have an "Aufenthaltsgestattung" until the court makes a decision on your appeal. That's very nice of you indeed it is so frustrating as you know 3 months is long time and for your understandig i haven't challenged the decision of BAMF as i have accepted it i am waiting to your response And again thank you so much.

Hello @Zabihullah . I have just spoken with the migration counseling center Caritas in Weißenfels. They said they are happy to help you. You can go there on Friday between 09:00-13:00 please ask them for an appointment. On Friday they will give you an appointment for a next counseling session with them. During your next appointment with them you can discuss all the issues with the Ausländerbehörde in Burgenlandkreis and they should support you. I have been to Critas and the only thing they did was sending an E-mail to Ausländerbehörde asking about the issue and the answer was again that the Ausländerbehörde need the that letter from BAMF that says my asylum application with BAMF has been closed and I have accepted their decision but I don't know have to get this letter even Carits doesn't know what to do

I am sorry to hear about your struggles with the foreigners department, @Zabihullah Usually, the BAMF decision will forwarded to the foreigners department through an online system. Unfortunately, this sometimes can take some time, even 3 months seems very long. My colleague asked a contact from the online system. Additionally, I will check who we can get to, since Caritas couldn't support. We will get back to you as soon as we receive any feedback!

As I understood you have already applied for the residence permit with the Ausländerbehörde in Burgenlandkreis, have you received a so called "Fiktionsbescheinigung" (fictional certificate) from the Ausländerbehörde? Yes, off course as I received my answer from the BAMF almost five months ago and after a week I send an application to Ausländerbehörde for the fingerprints and it took exactly four months to get the appointment right now I am waiting for the ID Card.
