Convert Residence Permit

Hi,My husband is a Blue Card holder living in Germany, and I am an Opportunity Card holder also residing in Germany. I would like to know if he can apply for a spouse visa for me while I am already in Germany. Additionally, is it possible to convert my Opportunity Card residence permit into a spouse residence permit without leaving Gemenay?

In general, for certain residence permits, it is possible to apply for a change of purpose within Germany if all requirements for the new residence title are met. Since your husband holds a Blue Card, his income should be sufficient. Additionally, you have a university degree, which means you do not need to provide proof of language proficiency.

In your case, switching from an Opportunity Card to a residence permit for spouses of a Blue Card holder should be possible without having to leave Germany.
Therefore, your marriage must be officially recognized. If you got married abroad, you will need your marriage certificate - if it is not in German or English, it must be translated and may require an apostille or legalization. 

If you tell me in which city your currently live, I can check your responsible foreigners department and their requirements for your application.

Today, I reached out to the foreigners department in Aachen to ask about your situation, as I couldn't find any specific details about a change of purpose on their website.

The person informed me that they review such applications on a case-by-case basis to ensure all requirements are met. So, before booking an appointment, you will first need to submit the following documents via email:

  • cover letter for an application (family member of an EU Blue Card holder) - I can propose you a suggestion this afternoon.
  • Passports (yours and your husband's)
  • Current residence permits (yours and your husband's)
  • Biometric photo (of you)
  • Your husband’s work contract
  • Last three payslips (of your husband)
  • Health insurance confirmation
  • Marriage certificate (if not in German or English, with translation and Apostille/Legalization)
  • "Meldebescheinigung" (registration certificate listing all family members living with you)

Please send these documents to auslaenderamt[@]staedteregion-aachen.de. They may request additional documents if needed.

I hope your application will be processed fast and can be handled within Germany. If you need local support, you can reach out to a migration counseling center. You can find varies in Aachen. On the map from BAMF you can narrow your search dowm by enter your zip code.

Hello @uswa you should combine the documents in one odf file and send it to the foreigners department. Please always use your full name and your birth date as a subject of the e-mail.

Transferring an Opportunity Card to a Residence Permit for a Spouse (Familiennachzug)

Yes, in most cases it is possible to change your status without leaving Germany, but it depends on many factors, including your current status, the conditions of your Opportunity Card, and your spouse's income.
You will need to apply to the Ausländerbehörde (immigration office) in your city. They may ask for proof of your spouse's income (the Blue Card requires a good salary), insurance, and registration.
Applying for a Spouse Visa While in Germany

Usually, such applications are submitted from abroad, but if you are already in Germany, you can try to change your status right here. This depends on the policy of the local office, so it is important to consult with a lawyer or the immigration office.
Some German states are more lenient about such changes, while others require you to return to your country of citizenship to apply.
How to proceed
