Declining after getting it
Hello. I wanted to know whether you can decline asylum after getting it. Example: I arrive to Germany for a few months, go to BAMF and ask for asylum on the grounds of me being trans/not wanting to go to war - if they decide that I can be granted asylum, do I have to accept that? Or is it as simple as ignoring their decision and coming back? (Also does home country get notified of asylum being asked for/granted?).
Thank you in advance

Hi @Emily , thank you for posting on our platform. Our experts from @LIFE Initiative will answer you shortly.

Hello @Emily , if you apply for asylum in Germany you have to live in refugee accommodation for up to 24 months. The Dublin procedure will be checked and you will have to go to the asylum interview. Then you have to wait for the decision of the BAMF. Here are more informations about asylum procedure: https://handbookgermany.de/en/asylum-procedure. If the decision is positive and you receive a residence permit, you do not have to accept it. You can simply leave Germany again. However, your residence permit will then expire and you may also be banned from entering Germany for a limited period of time. However, there are many other ways to come to Germany for a limited period of time (https://handbookgermany.de/en/visitor-visa) or migrate to Germany for residence and work. You can view the different types of visas and the conditions for obtaining them here: https://handbookgermany.de/en/immigration. The BAMF will treat your asylum application confidentially. We cannot answer whether your home country will find out about the asylum application or the granting of asylum.
Best Regards,
Franziska
