Expiration of dependent of EU BC holder

Hello,

I am a EU Blue Card holder and invited my family on FRV. Now they also have the residence permit based on my EU Blue Card with Type of permit for my Wife and Kid is : AUFENTHALTSERLAUBNIS.

 

Remarks for my wife in RP:

30 ABS. 1 S. 1 NR. 3G VAR. 1 AUFENTHG

Remarks for my KID in RP:

32 ABS. 1 S. 1 NR. 5 ALT. 1 AUFENTHG

 

Can someone please help me to understand what is the max time period they can live outside of GERMANY and EU in India?

Hello @Hemant , thank you for reaching out to us.

Generally, one cannot leave Germany for longer then 6months. If you leave Germany longer than 6months you will loose your residency. This regulation applies to all residency titles. There are some exceptions when it comes to the permanent residence.

The 6month rule also applies to your family members.

I can see the below :

 

EU Blue Card
  • An EU Blue Card expires 12 months after leaving Germany.
  • This period also applies to family members of an EU Blue Card holder if they hold a residence permit for family reasons.
  • A longer period can be permitted upon request if the stay abroad serves the interests of the Federal Republic of Germany. This is the case, for example, if you are working abroad for an international company based in Germany.

 

Here its mentioned 12 months for EU Blue Card and EU BC holder dependents who hold residence permit.

Is this something different then my condition?

Hi @Hemant ,

apologies, you are right, my first answer of 6months only applies for other residence titles.

With an EU Blue Card you and your family members can leave for up to 12months. This is because your family members have come through family reunification and you hold the Blue Card.
Before traveling please make sure that the residency is valid throughout the travels.
