German citizenship for my baby born in Germany

I am writing  with a request for information regarding German citizenship.
My son was born in Germany in November 2023 and is currently a Spanish citizen like his father. My child's father lived in Germany from November 2004 to August 2015 and then again from November 2019. Therefore, in November of this year his father will have lived in Germany for 5 years. However, he does not want to acquire German citizenship for himself. Is it possible for my child to apply for German citizenship if his father has lived in Germany for 5 years? If so, can you assist us with the process and what documents are needed? If not possible, when would my child be eligible to apply for German citizenship? Does he have to have a registration or apply for residence for this time to start counting?

Hallo @laurenpq  , thank you for getting in touch. Unfortunately your child cannot get German citizenship automatically because the father has not been in Germany for 5 years at the date of birth in 2023: https://handbookgermany.de/en/born-in-germany#faq_524 However, I advise you to get in touch with the migration advice centre https://bamf-navi.bamf.de/de/Themen/Migrationsberatung/ or contact a lawyer, maybe they see a way how your child can get the German citizenship.
