Grundgesetz für die Bundesrepublik Deutschland Art 16a

Hello, I have received my interview result on April 6th from BAMF ( immigration office in Munich) and I have been recognized as a person entitled to asylum accordance with Art 16 a para. Can you please help me to know what should I do now in order to complete the process of obtaining my ID card?

Additionally, I am currently working and my current work permit will expire by May 2nd, 2023. I need to get a Fiktionsbescheinigung until I receive my ID card. But don't know how or whom to contact with. Kindly guide me. Looking forward to hearing from you.

Hi, great that you have received your BAMF decision. Usually, you will receive the ID within three weeks of your decision via post. Did the BAMF write anything about this in your decision paper? It is important that the offices have your current address. If you have not received anything by that time you should book an appointment at the immigration office (Ausländerbehörde) in Munich and go, there with your BAMF decision. Now that you have received your decision from BAMF, your local immigration office will be in charge for your residency and work permit. Since you are a recognized asylum seeker under §16a GG you also have the right to bring your immediate family members to Germany. Please note that you only have 3 months to apply for an easy procedure of family reunification. After that date you need to fulfill more requirements for family reunification, like proof of sufficient income. More information on family reunification can be found here: https://handbookgermany.de/en/family-reunification To ensure that you have a work permit, it would be a good idea to go to the immigration office and ask for an extension of your Fiktionsbescheinigung. Dear Yara, many thanks for your wise feedback. It was very helpful. Concerning my current address, I have recently moved to my new apartment however my husband already requested for permission of changing my address and submitted my application . I am still receiving my posts to my old address. In regards to family reunification, I would like to ask that would it be possible if I request to bring my widowed mother and single sister to Germany? Furthermore, the documents that I received from BAMF contain some information about my asylum case recognition and my rights, but nothing is mentioned about when or how can I receive my ID card. I would highly appreciate to have your advice. Thank you Narges

Dear @narges.sharifi I just also called the refugee council in Munich. They recommended that you go to the immigration office and get your Fiktionsbescheinigung extended. Since they are currently very busy, and it will likely take a while until you receive your ID in the mail. According to the website it says that, if you have just finished your Asylum procedure can go without an appointment. https://stadt.muenchen.de/service/info/hilfe-bei-fehlendem-aufenthaltst… If you are not able to make an appointment before the 2nd of May then it would be a good idea to make use of the emergency time. Please go to the immigration office at Seidlstraße 27, 80335 München with your asylum decision from BAMF. It would be also a good idea to make a copy of the original. the opening times are as follows:
  • Mon. 7.30am – 12pm
  • Tue. 8.30am – 12pm and 14pm – 18pm
  • Tue. 8.30am – 12pm and 14pm – 18pm
  • Thur. 8:30-12pm and 14pm-18pm
  • Fr. 7:30am-12pm
Please be prepared for long waiting time. It would be good to show up early and take drinks and snacks with you. Unfortunately, you can only bring your immediate family to Germany. This means your underage children and your spouse. Your single sister and windowed mother do not fall under immediate family. There are exceptions to this rule. For example, in case your windowed mother and single sister are depended on your care, for this you will have to seek out a counseling center that can further help you with this case. You can call Refugio tomorrow from 14:00-16:00 and make an appointment, to see if they can further help you. Dear Yara, Many thanks for your great support and I highly appreciate it. Regarding your inquiry, I would like to let you know that I have contacted the Refugio and unfortunately their response was the same as I assumed that it is not possible to invite them here.

Hi @narges.sharifi , I am sorry to hear that. Unfortunately, the hurdles are extremely high if you want to bring "non immediate" family to Germany.

Dear @narges.sharifi , thank you for your question. Usually, the immigration office will give you a so-called certificate of eligibility or “Berechtigungsbescheid”. With that letter you can apply directly to the school that offers an integration course. If you have not received this certificate, please fill out the application application and send it to the closet BAMF center near you.
