Inquiry about post application for permanent residence permit (Niederlassungserlaubnis)

Hi everyone, 

i'm living in germany since mide of 2018 and at the beggining my asylum application got rejected by BAMF then on 2022 i have recevied my Resdency permit as a Refugee 3 years residency with Refugee Travel Document, now this three year will expire on 2025.

the question here is i want to apply for Permanent residency before my current residency will be expire, so i have all the requirements for Permenant residency as : Integration course Niveau B1, Permanent working contract, my own apartment, that five years i have no fine and so on.

for Permanent residency it will count from the first day i come to Germany ( 2018) or the day i got my residency is count ???? Can i apply for for permanent residency in the beginning of 2025 ?

your kind assistance will be greatly appreciated.

Hello @Barin thank you for your valuable question. If I understand you correctly, you applied for asylum in 2018, appealed your rejection and were recognized as a refugee in 2022. Congratulations! As a recognized refugee you have easier conditions to apply for a permanent residency (PR), for example the time from the application to the recognition as a refugee counts as well. To find out the exact time is a bit tricky, because either the day you arrived nor the time you received your residence permit is correct. You can find the exact date on the green paper "Aufenthaltsgestattung" you received back then or on your notification from BAMF. To make sure that you reached the necessary time to apply for a PR, you can consultate a migration counselling center. They can review your documents and check the dates with you in detail. I am happy to support you finding a councelling center close to you. Please tell me the city you live in or the next bigger city. Please note that, beside the integration course, language skills and a more likely secured livelihood, you need to have enough space in your apartment and complete an orientation course. Hello there, Thank you very much for your quick response and for your clarification. Thta is a wird ! I live in Free state of Thuringen, City Erfurt. Would be very nice of you if you can helpme with nearest Migration counselling center. and regarding your last point, Yes i have all the requirements i have finished orientation course and i have my own apartment and so on. all the requirements are exist in me :) Sincerely, Barin

Hello once again :) So i have made the online counseling with Caritas, that was there answer as per below ; (( Sehr geehrter Herr Barin, laut meinen Informationen erfüllen Sie die Voraussetzungen für einen unbefristeten Aufenthaltstitel. Die Jahre sollten ab Asylantragsstellung bereits gezählt werden, das heißt ab dem Jahr 2018. Die Voraussetzungen für einen unbefristeten Aufenthaltstitel beinhalten Pflichtbeiträge von 60 Monaten (5Jahre). Diese sollten theoretisch im November 2025 erfüllt sein. Aufgrund Ihrer ehrenamtlichen Tätigkeit können Sie aber versuchen bereits vorher einen Antrag zu stellen. Ich empfehle Ihnen auch sich diesbezüglich von der Ausländerbehörde vorab beraten zu lassen. Bei Rückfragen können Sie sich gerne wieder melden. Mit freundlichen Grüßen )) So then in this case it means i have a chance in order to apply for the permanent residency permit by next year, isn't it ? as the new citizenship law will start in January 2024, it made easier for the permanent residency permit application as well. the amount of time is shortened.

Hello @Barin , yes, the migration counselor has told you that in theory you will fulfill the 60months of contributions to the pension in November 2025, but they suggested that you can also try and apply earlier then that because you have done some volunteering work. They recommend that you seek counseling form the immigration office regarding applying earlier because of your volunteering work. The new law will make it easier to receive a German passport faster under certain conditions. I am happy to help if you have further questions. Best wishes
