Inquiry Regarding stay permission Application and Support for Two Pakistani Brothers

Dear Sir/Madam,

I hope this message finds you well. I am writing to seek guidance regarding the case of two Pakistani brothers, aged 20 and 30, who were born and raised in Saudi Arabia. Following the passing of their father, the elder brother took all their belongings and subsequently sent them to Pakistan, while canceling their visas without prior notice. This abrupt action has left them in a precarious situation.

For the past year, they have faced significant mental and emotional distress, resulting in profound depression. Additionally, their physical health has deteriorated, leading to frequent illnesses.Given their circumstances, I would like to inquire if they may be eligible to apply for asylum?

Furthermore, I would appreciate your advice on which city might be most suitable for them to settle in?

I would like to understand whether they would be able to continue their studies upon receiving asylum? Should they proceed with traveling there on a visit visa? In this situation, should they reach out to BAMF prior to their departure or after arriving?

Additionally, would it be more advantageous for both brothers to undertake this together, and could there be any potential issues?

Hi @her-syd.buk  , I'm sorry to hear about the difficult situation of the two brothers.These answers are provisional, as we do not know the exact situation and cannot give legal advice.
The brothers can only apply for asylum if they are in Germany. Within Germany, they would need to contact the German authorities, i.e. a local police station, the Immigration Office, an arrival centre ("Ankunftzentrum") or an initial reception centre ("Erstaufnahmeeinrichtung") and inform them that they want to apply for asylum. Unfortunately, we cannot answer the question of whether their health problems can be a reason for asylum or protection from deportation, as we do not offer legal advice.
When the brothers are registered as asylum seekers, a computer system is used to check in which city there are free places in accommodation and which city is responsible for the brothers' country of origin. As Asylum seekers they can study in Germany and obtain a Bachelor´s or Masters degree. They do not need a permit from the immigration office to study (see: https://handbookgermany.de/en/aufenthaltsgestattung#faq_119) .If they fulfil the requirements, they can apply. There are no advantages if the brothers enter the country together and apply for asylum. If the brothers do not enter together, it is more difficult to ensure that they can live in the same accommodation. Therefore, we would recommend entering together if the brothers wish to stay together.
