Options for getting temporary residence permits in Germany

Hi Team,

You have been very supportive and patient with my questions. Thank you very much for your great job!

Today I want to ask you for clarifications regarding the section Ukraine/Residence/ What options do I have for a long-term residence in Germany?

In short, it says that apart from Paragraph 24. or Asulym, you can apply for a long-term visa directly at the immigration office responsible for you as long as you meet the requirements for a long-term visa (e.g. a student visa, a visa for a skilled worker, family reunification, etc.). 

Is there a chance that the statement refers to the possibility of applying directly for a residence permit, not a visa?

It`s a bit confusing as when you are already inside the country, an application for a visa seems unnecessary, and anyway normally visa is processed by DE embassies abroad and not by local immigration offices. In other words, eligible Ukrainians should be able to enter Germany visa-free and only apply for a residence permit (e.g., skilled worker, Blue Card) inside the country, without an obligation to apply first for a national visa in the immigration office OR embassy abroad. Is that right?

Hi @Ruslana thank you for your question. It is true that visa applications are only made at the German embassies or consulates outside of Germany. I will check if we need to adjust the section, thanks for letting us know. For Ukrainians outside of Germany who are eligible for temporary protection there is no need to apply for a national type D visa at the embassy abroad. Those who fled the Ukraine and hold §24 can apply for for other residence permits. at their local immigration office in Germany. Please note that we have received updated information regarding the change from §24 to the Blue card. Unfortunately, the regulation is not clear yet. Hi Yara, Thank you very much for your reply. My understanding is that within 90 days after entering Germany, eligible Ukrainians can apply for a residence permit for a different purpose than prgrph.24. I mean they do not need to apply for prgrph.24 first and then switch. Please confirm. I wish you a happy holiday season!

Yes you are right within 90 days after arriving in German, eligible Ukrainians can apply for a residence permit other than §24. They do not have to apply to §24 and then switch.
