Problems with extension of my resident permit

Hello,

I have a question for my Aufenthaltstitel. My husband has Niederlassungserlaubnis. He works at uni. He writes projects and works on them with his coworkers. Now his project/contract ends in November and he is waiting for the results of the new projects he has written. Sometimes the results are announced late.

 

I don’t have Niederlassungserlaubnis. My Aufenthaltstitel ends this month and Ausländerbehörde tells me they cannot extend it unless my husband brings the new contract beginning from December.

 

I am an engineer and right now in the job hunt. No luck till now. Also My husband and I both have non-EU passports.

What are my options at the moment? What can I do to extend my permit?

Will I have to go back to my home country if my husband’s new projects delay or don’t get approved?

Hello @kiwiroot thank you for reaching out. This sounds like a very tricky situation. May I ask what residence permit you are holding? Since your permit will expire soon, it is recommendable to schedule a new appointment with the foreigners department and explain your situation. Additionally, you should ask for a so-called "Fiktionsbescheinigung". This is a temporary extension document of your current permit. This will give you and your husband some time to provide the necessary paperwork for your actual extension. You can consultate a migration counselling center in your area to go through your documents with you and discuss more options. Also, they can provide some legal advice, in case the contract of your husbands project will take longer or you won't find a job. You can have a look at this search mask from BAMF or please let me know your the city you are live in. I am happy to support you. . Hello. Thank you for your answer. I have Aufenthaltserlaubnis, remarks/ Armerkungen written as 30. My husband has Niederlassungserlaubnis. We have been living in Germany since 2019. (married long before) I asked Ausländerbehörde for a Fiktionsbescheinigung. It is issued right now. But it doesn't look like it gives me much time. Hence I am worried that I will be sent to my home country while my husband is here. I will search if there is a migration counseling center around. I have never heard of them before. I really appreciate your answer. I will also take a look at the links you provided.

Thanks for getting back, @kiwiroot I am very glad to hear that they have issued you a Fiktionsbescheinigung! Usually they grand a duration between 3-6 months. Did they issued you a similar period? Please let me know in case you need support finding a suitable migration counselling center or have further questions.

@My Nguyen_Community Managerin Thank you so much for your answer. Unfortunately, my Fiktionsbescheinigung is just for 1,5 months. I took a look at the links you have provided and have contacted two of these centers that are around where I live. I am waiting for an answer from them. I really appreciate your help.

Indeed, this is quite a short time, @kiwiroot In case your Fiktionsbescheinigung will expire before you have your necessary documents to present, you can ask for another extension of it.
