Providing Residence Permit

I would like to inquire about my situation and ask if I can apply for asylum. I am Palestinian but lived as a refugee in Syria. I have two passports, one from the Palestinian Authority and one for Palestinian refugees in Syria. I came to Germany on the 9th of October with a family reunification visa (newly married), I have health insurance from my husband's insurance company and I have a permanent home address. I would like to apply for asylum. Do I have the right and how do I apply for asylum? (My husband is a German citizen).

When coming to Germany with a Family Reunification Visa ist is important to immediateley apply for a "residence permit for the purpose of family reunification" (Aufenthaltserlaubnis zum Zweck der Familienzusammenführung: (§§27-36a AufenthG) at the immigration office (Ausländerbehörde). Usually this application is processed quite fast. 

Also you should register your address at the Bürgeramt / Einwohnermeldeamt, if you haven't done that yet. Although from what you said in your message about having a permanent home address, it seems as if you already registered. The process of applying for asylum is independent and can be initiated at the same time as the application for the residence permit for the purpose of family reunification. You can apply for asylum at the Federal Office of Migration and Refugees (BAMF). The answer to your question as to whether you have the right to asylum is a difficult question to answer, as we are not able to give legal advice. Applying for ayslum can have both advantages and disadvantages though, which is why we would reccomend you to contact a migration advice center.  

However, from what you write, we cannot yet determine what motives you might have for an asylum procedure. As the wife of a German citizen with a visa for family reunification, you are probably entitled to a residence permit, which in most cases represents a better status than an asylum procedure.
