Request for Legal Advice Regarding Humanitarian Residence Permit / Hardship Case

My name is MX, and I am a Malawian citizen currently residing in Berlin. I came to Germany in 2022 as an international student and completed a Master's degree at a German university recognised by the state of Berlin.
After graduation, I received an 18-month residence permit to search for employment. Unfortunately, due to language barriers (many roles require B2 German), I have not yet secured a job in my field. My jobseeker visa is now close to expiring, with only 1 month left.
I am also living with a chronic illness and receiving continuous, specialised medical treatment in Germany. Returning to Malawi would endanger my life due to the severe breakdown in the country’s unpredictable donor-dependent care system.
Additionally, I am an active board member of a registered nonprofit (e.V.) in Germany that promotes intercultural dialogue and international understanding—evidence of my ongoing integration and community engagement. I managed to pay for my language course up to the A2 level, but I could not continue due to limited finances, now, I am learning online on Deutsche Welle.
Given this context, I would like to explore the possibility of applying for:
- A humanitarian residence permit under §25(5) AufenthG, or
- A hardship case review by the Härtefallkommission under §23a AufenthG.
I have already drafted supporting documents, including a doctor’s letter and evidence of integration, and I am seeking legal advice on how best to proceed, especially now that I only have one month left before my current permit expires.

It has already been a couple of years but congratulation on completing the master degree. Also, great that you are continuing to learn German.
Unfortunately, we can not offer legal advice here. I would suggest maybe visiting an asylum migration center before choosing to go applying for an asylum or humanitarian status. They also should have contacts to lawyers who they can recommend. For example the Willkommenszentrum does counseling in English
