Residence permanent permit according to §28 (1) No. 3

Hello, 

I hold an (Aufenthaltstitel) according to Paragraph 28 because my son is German. This is my 6 year in Germany and my residency is due to be renewed. I was wondering if I can apply for the permanent residency but without B1 certificate. I have attended courses until A2.2. Do you think it is okay to apply for it with a certificate of attendance from a language school? 

I have not done the integration course due to my full time job. Not sure if this helps but I came to Germany as a skilled worker and then changed my residency type to P. 28. 

I have a permanent contract and hold a master's degree in my qualifications. My job is merely in English. 

Any advice would be helpful. Thanks

Hello @EgyinGermany  , Thank you for contacting us. If you wish to apply for permanent residence, you will generally need to meet a number of requirements. One of these requirements is knowledge of German at level B1. A certificate of attendance can show your commitment to learning German, but it's unlikely to replace the B1 certificate for permanent residence purposes. A basic knowledge of the German legal and social system is also required, although this is often not explicitly mentioned. Do you know if I can take an integration test without attending the integration course? 

Now, that I will have to renew my residency since I am not eligible for the permanent one due to the B1 requirement, can I still apply for the permanent residency whilst my normal residency is valid? for example in 6 months or so or does it have to be when it is due to be renewed?

I have just been reading about obtaining a Blue Card. Can I apply for it with my Aufenthaltstitel P.28? As far as I know, I meet all the requirements. Would that make it quicker or easier? Thank you in advance for answering all my complex questions. :)

I have some good news for you. You will not need to do the integration test or “Leben in Deutschland test” in order to receive the permanent residency. See this accordion: https://handbookgermany.de/en/permanent-residence-migrants#faq_551
You can also see the requirements on the website of the immigration office of Berlin, there is no mention of the test. https://service.berlin.de/dienstleistung/327012/en/

However, you will need the B2 German level.

You can also apply for a Blue Card, if you fulfill the requirements. With a Blue Card A1 German knowledge is enough for a permanent residency.  However, you will receive the permanent residency only after 27months with the Blue Card.

Hi @EgyinGermany ,

So the requirements depends on your current residency. You mentioned you hold residency §28 because of your German son. Then the following requirements apply

  • You must have the residence for at least 3 years
  • You must speak German at B1 Level, as far as I know there are no exceptions so Level A2 is unfortunately not enough.
  • You must be able to secure a livelihood and not not receive any support from the JobCentre or Social Welfare Office

    I'm not sure what you mean when you asked are there different types of this residency? Do you mean the permanent residency. The requirements for this residency depend on your current residency, for example §28 has slightly easier requirements that other residencies.
