Residnce Permit for National D visa holder

Hello,

I am an international student from India, at present studying in a university in Berlin. My study course will continue till March 2026.

I arrived in Germany on 10th Jan 2025 with National D student visa valid till 27th Dec 2025.

My questions are:

1. When can I apply for a Residence Permit?

2. If I go to my native country India now and return after two weeks, will it affect my Residence Permit processing?

Thanks & Regards,

Chinmay ******

Hello @Chinmay ,

thank you for your question.

You can apply for a residence permit as soon as possible after your arrival in Germany, ideally within the first 90 days of entering the country. However, some branches of the Foreigners’ Office may advise you to apply even earlier. Therefore, I recommend that you begin the process without further delay.

For your second question, if you have not yet applied for your residence permit and you leave Germany, it is generally fine—as long as your National D visa is still valid when you return. So yes, you can travel to India and come back without any issue, provided that you return before your visa expires, and you have a valid passport and visa upon re-entry.

However, if you already have an appointment scheduled at the Ausländerbehörde or are in the middle of the residence permit application process, it is advisable to consult the relevant authority before traveling. This is a precaution to avoid any potential complications with your application.

I hope this has been helpful.
