Seeking Residency in Germany

My name is Sinai. I am an international student who came to Malta on a student visa for the 8-month Nursing bridging course and was 32 weeks pregnant during my entry date. I came with a 91 days entry - long stay student visa. My school Idea Academy wrote to Identita Malta to revoke my Visas after I made payment for current and upfront tuition fees. Please can I move to Germany to seek asylum?

Hi @Sinai , thank you for your inquiry.

To begin with, here’s an important piece of information: You can only apply for asylum if you are in Germany. To briefly summarize the process: Within Germany, you would need to contact the German authorities, i.e., the immigration office, an arrival center, or an initial reception center, and inform them that you want to apply for asylum. You will then be taken to an initial reception center for refugees to register. You will either be given an appointment with the BAMF ("Federal Office for Migration and Refugees") at the registration or later by mail. At this appointment, you will officially submit your asylum application. The BAMF will then check whether Germany or another EU member state is responsible for your asylum procedure ("Dublin-Verfahren"). The Dublin Regulation regulates in which country the asylum procedure is carried out. This means that the Federal Office for Migration and Refugees (BAMF) will first check whether your asylum proceedings are taking place in Germany before the BAMF invites you to an interview. As you have a student visa in Malta and have fingerprints in Malta, a Dublin procedure will be conducted. This means that you will most likely be sent back to Malta. If you are not yet in Germany, there may also be other ways for you to come to Germany to live and work (i.e. residence permit to study or work)

What can you do next?
