Spouse of permanent residence who are previously a blue card holder

Hi

Me and my husband moved to Germany in July 2022 with me holding a BlueCard and him on family unification.

I just got my permanent residency and I am wondering if my husband can apply soon this July when we reach the 3-year mark. He’s currently working as a Azubi (38,75 hours per week, but 2 weeks per month, the other 2 weeks he goes to Berufschule). Does this meets the qualification of working 20 hours per week? 

And, can a Einbürgerhungs test result replace the orientation class?

Congratulations on your permanent residency! To answer your question better, can you please tell me whether your husband still holds a residence title after family reunification or has changed to his own title due to his Ausbildung?

As I am unfortunately unable to offer you any legal advice and do not know your exact documents, I can only point you in a possible direction.

As a rule, family members of permanent residence permits can apply for their own permanent residence permit after 3 years if they meet all the requirements. These include a secure livelihood, an employment and proof of language proficiency (B1). You can find more information on Handbook Germany.

Whether the "Einbürgerungstest" is sufficient instead of the orientation course will depend on the case officer. Since he is in a vocational training, this may also be sufficient in some cases. Otherwise, he could take the “Life in Germany Test”. That would put him on the safe side. As I said, everything unfortunately depends on the case worker.
