Switch from 24 AuftG to 18b

Hello, I have a question regarding the switch to 18b from the 24 paragraph. I have already glanced at the new rules, which state that your job shouldn't match your qualifications one-to-one. In my case, I have a job that is considered a high-skill job but is not directly related to my engineering background. I am a civil manager, and the job is in property management for now, and later as a technical property manager with a high salary above 44k. I am also a volunteer with high integration and language skills, including the LID test, and everything. Is it possible for me to apply for the 18b or not? Does it require an official "Tätigkeitsbeschreibung" from the employee, or is the job contract enough? Thank you so much in advance.

Hi there! You are well integrated into Germany, good for you!

In principle, a switch can be possible, but it depends on recognition of your degree and whether the job is classified as a “skilled worker” position under German law. Your university degree must be recognised in Germany (check it on anabin.kmk.org). The position does not always need to be a one-to-one match with your field of study, but it must be related and of appropriate qualification level. Property management roles can qualify if they are technical/managerial.

A detailed Tätigkeitsbeschreibung is usually required in addition to the contract, since the authorities need to check if your tasks correspond to a skilled profession.

I am not an expert, so it would be best to confirm with your local Ausländerbehörde.

Hope this helps!
