Ukraine - residence permit - not a refugee
Dear all,
my name is Olesia, I am a student from Ukraine, but I study in Poland and do not fall under par. 24. I am in Germany for one semester participating in an exchange program, so I am enrolled at the university only for one semester. I currently stay on a visa-free basis, but my 90 days limit is coming to an end. Could you please advise if I can somehow extend my stay in Germany?
There is a difficulty with receiving Visa for Erasmus scholarship holders as it requires a valid D-type Polish visa. My Polish visa is now expired, though it is automatically prolonged until the end of this year by the rule of law (there is no mark about it in my passport) and after visa expiration, I can legally stay in Poland for 18 months. Obviously, I cannot go back to Ukraine and apply for a new student visa. I meet all other requirements except for this one, so I am not sure what should be done in my situation.
I also thought of another option... Is there a possibility that after applying for par. 24 my application will be rejected, but I will receive a Duldung or Fiktionsbescheinigung which will allow me to finish my semester in Germany without any problems?
I will appreciate any help.
