Unfair dismissal

Can my partner get free legal representation for a justified unfair dismissal claim?

Hi @Ralt#78 , thank you for reaching out. 

In general, legal representation is not free. Since I do not know much about the case I would suggest you first contact a suitable counseling center. It's possible that they can also help for free. 
If you let me know what city your partner is in I can look for a suitable counseling center. 

If you are sure you want/need legal representation and have no funds then you can apply for a so called Beratungschein (Legal advice certificate) and  Prozesskostenhilfe (Legal Aid)

This means that the state can help you cover the costs. You might be asked to pay the costs back once you have enough income.

Hello @Ralt#78 , we are a counsultation project ("Faire Integration") for people from non-eu-countries. If your partner comes from a non-eu-country it is possible to get a consultation  for employment law from us free of charge. For people from the european union the project "Faire Mobilität" is responsible.  As you maybe already know if someone wants to take steps against an unjustified dismissal they do not need a lawyer to file a lawsuit with the labour court. However, if your partner wants to be represented by a lawyer nevertheless, it is possible to apply for legal aid ("Prozesskostenhilfe") if there is only very little or no income. 
Please note that a lawsuit against a dismissal needs to be filed within 3 weeks after receiving a dismissal. You or your partner can write us an e-mail with the contract and the dismissal, so we can tell you if a lawsuit makes sense and might be successful.
