Visa change from Spouse of Blue card holder to skilled worker

Hello,

I am writing behalf of my spouse, who is a registered nurse here with 'Urkunde' and currently working under my Blue card visa for last 2.5 years. We would like to change her visa from spouse of Blue card holder to skilled worker category so that she will be eligible for applying permanent residency ( as per the information from internet).  

How can we change the visa category. is it possible to do online application?.

Hi, Jenson! I’m not a legal expert, just a volunteer here, but I’d like to share some helpful information.

It is possible for your spouse to change from a family residence permit to a skilled worker residence permit, provided that she meets the requirements.

The application usually has to be submitted at your local Ausländerbehörde (foreigners’ office). In most cases, this cannot be done entirely online — you usually need to make an appointment and submit documents such as:

  • The Urkunde/recognition certificate of her nursing qualification
  • Current employment contract
  • Proof of salary that meets legal requirements
  • Valid passport and biometric photo

Some cities allow uploading documents online before the appointment, but the final step is typically in person.

In addition to Anna's response, I just wanted to add that your spouse might want to consider switching to their own residence permit as a skilled worker. Since your spouse has already been living in Germany for about 2.5 years, they'll be eligible to apply for permanent residency after five years anyway. You can read here more about the requirements for a permanent residency.

However, if your spouse changes their residence title to a skilled worker permit, they could qualify for permanent residency only slightly earlier - after 21 months if they get a Blue Card, as long as they meet all the requirements. If they get a skilled worker permit based on vocational training, then it would take about three more years before they could apply for permanent residency. This would mean that your spouse need more than 5 years to be able to apply for a PR.

You might want to check our options with a migration counseling center. You can find one on the website of BAMF, when you enter your zip code. In case you need support finding one, I will be happy to help, if you tell me where you currently live.
