Visa Expiring while travelling outside Schengan- How can Re-Enter in Germany
Hello Team,
Urgent advice needed!
We (Me, My Husband & Minor Son) had to travel to India on End of Nov-24 due to exigency in first family with return planned for End of Dec-2024.
Due to personal family situation I had to stay back in India with baby & my husband travelled back already, currently he is in Berlin he will come to India tentatively in mid Feb-2025 and we are planning to return back to Berlin together tentatively by end of Feb-2025 (return tickets are not booked yet)
My husband’s hold Blue Card and he applied for PR in July – 2024 no progress on that (Myself para: 30 Abs 1S. 1Nr. 3g Var.1) and baby are on dependent Visa). Since this travel was not planned and my husband was expecting PR Appointment we didn’t applied for BlueCard/RP renewal as well which is set to expire on 10.02.2025
Now, the issue is how we can we get re-entry Visa for Germany, possible options:
• My Husband applies for renewal of Blue Card now and the apply for “Fiktionsbescheinigung” through contract form after booking tickets.
• Apply for re-entry Visa from VFS (Delhi) which might be lengthy process– No appointments available for National Visa trying since 1 Week.
• Is there any possibility to get “Fiktionsbescheinigung” on behalf of me to my husband with some sort of power of attorney or through Lawyer?
Looking forward to hear back on suggestion and possible options. Thank you very much!
Hello @sg2703
Thank you for your question. Unfortunately, we cannot offer legal advice on visa issues. Please contact a lawyer for further consultation.
In principle, it is always advisable to extend your current residence permit, even if you are applying for a permanent residence. Unfortunately, the application process is very slow and with an extension of your current residence permit you will always have a basis for your stay in Germany.
If you have had a residence permit in Germany and it expires while you are abroad, the usual way is to get a re-entry visa. You seem to know and meet the requirements for re-entry.
If your family residence permit and your child's residence permit have not yet expired, you may be able to apply for an extension.

I wish you all the best!
